'You might not think about copyright very often, but we are all copyright owners and authors,' the report states, emphasizing that in the age of AI, these protections have become crucial.

At the heart of the debate is the US Copyright Act of 1976, which defines copyright as protections for 'original works of authorship fixed in any tangible medium of expression.' This includes books, art, music, movies, and even blog posts. The US Copyright Office, the federal agency overseeing these matters, has issued guidance stating that works entirely generated by AI are generally not eligible for copyright protection. However, if human creators use AI tools for editing—such as adding or removing objects in images or refining audio—they can still seek protection, provided they disclose the AI involvement.

In one notable case, a company successfully copyrighted an AI-generated work by demonstrating significant human input and creative manipulation. The Copyright Office's second report on AI, released in 2023, reaffirmed this stance, noting that pure AI creations lack the human authorship required for protection. On the training side, AI firms have faced accusations of using copyrighted material without permission, leading to over 30 lawsuits in US courts.

Among the high-profile cases is The New York Times v. OpenAI, filed in December 2023, where the newspaper alleges that ChatGPT reproduced reporters' stories verbatim without attribution. Similarly, Ziff Davis, the parent company of CNET, filed a lawsuit against OpenAI in April 2024, claiming infringement on its copyrights during AI training. Another suit, led by concept artist Karla Ortiz against Stability AI in early 2023, represents a class action from creators alleging unauthorized use of their works.

Tech companies defend their practices by invoking the fair use doctrine, a key provision of the 1976 Copyright Act that allows limited use of copyrighted material without permission for purposes like education or news reporting. Fair use is evaluated based on four factors: the purpose of the use, the nature of the work, the amount used, and its effect on the market. Christian Mammen, an intellectual property lawyer and managing partner at Womble Bond Dickinson's San Francisco office, explained the complexities in an interview with CNET: 'Does that apply on the input side, where you take the whole work in this training data, or does it apply on the output side, where there may be an unrecognizable, tiny bit of influence by any particular work in the output?'

Mammen highlighted the debate over whether AI training qualifies as transformative enough to warrant fair use. Tech firms like Google and OpenAI argue that it does, with Google stating that such an exception is essential for rapid innovation, and OpenAI framing it as a national security issue. In its third report on AI and copyright, issued in 2024, the Copyright Office acknowledged that fair use might apply in some cases but not others, leaving the matter to the courts.

Recent rulings have favored AI companies in some instances. In a decision in October 2024, a judge ruled in favor of Anthropic, deeming its use of copyrighted books 'exceedingly transformative' and thus fair use. Authors affected by the alleged piracy can claim compensation from a $1.5 billion settlement fund. Just two days later, Meta won a similar case, bolstering the argument that AI training on copyrighted texts can be permissible.

Not all stakeholders agree. In March 2024, over 400 writers, actors, and directors signed an open letter to the incoming Trump administration, urging against granting OpenAI and Google a broad fair use exception. 'Google and OpenAI are arguing for a special government exemption so they can freely exploit America's creative and knowledge industries, despite their substantial revenues and available funds,' the letter stated. 'There is no reason to weaken or eliminate the copyright protections that have helped America flourish.'

Some copyright holders have opted for licensing deals instead of litigation. Publishers like the Financial Times and Axel Springer have secured multimillion-dollar agreements with AI companies, allowing controlled use of their content for training purposes. These deals underscore that when permission is granted and fees paid, the use is legal and mutually beneficial.

Decades of copyright law precedent say that such a use, without permission, is not allowed. Some of the creators are alleging that the tech companies infringed on their copyrights. Infringement occurs when a copyrighted work is 'reproduced, distributed, performed, publicly displayed, or made into a derivative work' without the permission of the copyright holder, as the Copyright Office defines it.

As lawsuits progress, creators remain in limbo, awaiting clearer rules. The Copyright Office continues to update its guidance, with reports emphasizing the need for disclosure in AI-assisted works. Meanwhile, the tech industry's push for fair use could reshape how content is valued online, potentially saving companies billions but at the expense of individual creators' rights.
